Learned counsel for the petitioner would submit that the petitioner presented a document dated 01.10.2025 (Ex.P1) before the 3rd respondent. The petitioner also submitted another document, dated 01.10.2025 (Ex.P2), before the 3rd respondent. Learned counsel further submits that the 3rd respondent did not register the said documents by following the procedure mandated under the Registration Act, 1908. 3. Learned Assistant Government Pleader, on instructions, would submit that the 3rd respondent received both the documents and assigned P148/2025 and P146/2025. Thereafter, an order was passed under Section 71 of the Registration Act, 1908, (hereinafter referred to as ‘Act’,) on 01.10.2025. If the petitioner is aggrieved of, by the said order, the petitioner has to challenge the same by way of appeal under Section 72 of the Act. 4. In reply, learned counsel for the petitioner sought liberty to challenge the endorsement dated 01.10.2025, passed under Section 71 of the Act by the 3rd respondent, before the appellate authority. 5. Given the facts and circumstances the writ petition is disposed of at the stage of admission, with the consent of the counsel appearing on either side, granting liberty to the petitioner to challenge the refusal endorsement dated 01.10.2025, issued by the 3rd respondent under Section 71 of the Act, before the appellate authority. There shall be no order as to costs.
