01. Mr. M. S. Reshi, learned counsel for the petitioner places reliance upon the order dated 06.06.2024 passed by a Coordinate Bench of this Court in “WP(C) 1240/2024” titled “Sajad Ahmad Malik & Anr” vs
“The Jammu and Kashmir Bank Ltd. & Anr”. He has submitted that the petitioner will not oppose any action of the respondent Bank in execution of the auction and in the event the auction is finalized, the petitioner shall not cause any hindrance in handing over of the possession to the Bank or the successful bidder in the auction.
02. Mr. N. A. Dendroo, learned counsel for the respondents has no objection in this regard.
03. Writ petition disposed of on the above term. Till the auction is finalized, the possession of the petitioner shall not be disturbed.
