The present appeal is filed being aggrieved by the impugned order dated 16.10.2025, passed by learned Judge, Family Court, Raigarh, District - Raigarh (C.G.) in Civil Suit No. 140-A/2025, whereby the application under Section 24 of HEERA LAL SAHU Digitally signed by HEERA LAL SAHU Date: 2025.11.20 16:40:46 +0530 2 the Hindu Marriage Act filed by the appellant/wife has been partly allowed and partly rejected. 2. Learned counsel appearing for the appellant seeks permission of this Court to withdraw the present appeal with liberty to file a fresh petition under Article 227 of the Constitution of India, in light of the decision of this Court passed in FA(M) No. 149/2015 (Anil Mishra vs. Sakshi Mishra) on 22.02.2017. He also submits that the certified copy of the impugned order may be returned to him. 3. In view of the above submission made by learned counsel appearing for the appellant, permission is granted. 4. Accordingly, the appeal is dismissed as withdrawn with the aforesaid liberty.
