CORAM: HON'BLE MRS. JUSTICE SUKHVINDER KAUR ....... Present: Mr. Naresh Gopal Sharma, Advocate for the petitioner. *** SUKHVINDER KAUR

Prayer in the instant petition filed under Section 528 of BNSS, is for issuance of direction to the trial Court to decide the case i.e. FIR No.115 dated 21.10.2021, under Sections 307 and 326-A of IPC (Section 307 IPC deleted later on and Section 302 IPC and Section 3(2)(v) of SC/ST Act added later on), registered at Police Station Mohkampura, District Police Commissionerate, Amritsar, expeditiously in a time bound manner.
Learned counsel for the petitioner has contended that on 17.10.2021, Manpreet Singh (since deceased) i.e. son of the petitioner along with his wife and children went to take medicine and then his wife Saira took him to the house of Sheetal (sister of his wife), where accused persons manhandled him and poured oil upon him and set him ablaze. After sustaining injuries, Lovepreet (brother-in-law) of the deceased got him admitted at Sarin Hospital and thereafter, he was admitted at Amandeep Hospital. CRM-M-28758-2025 (O&M) -2- statement of Manpreet Singh (since deceased) the aforesaid FIR was registered against the accused persons. Due to the injuries sustained by the victim, he expired on 01.11.2021 and Section 302 of IPC was added in the said FIR. Thereafter, investigation of the case was carried out and challan was presented before the trial Court on 14.10.2022, however, the petitioner (father of deceased) approached the authorities and requested to add offence under Section SC/ST Act as deceased and accused persons belong to Scheduled Caste. The matter is pending before the trial Court and despite the lapse of considerable time of about more than two years of the registration of the FIR, the proceedings are still at the initial stage and even the charges are yet to be framed. However, the matter continues to be adjourned from time and again for one reason or the other, resulting in undue delay in progress of the trial. Thus, as the trial in question is pending before the trial Court, direction may be issued to the trial Court to expedite the trial in a time bound manner. Heard. Vide order dated 23.05.2025 passed by this Court, report from the concerned Court was called for. In compliance of the order of this Court, report dated 11.08.2025 from the trial Court has been received, in terms of which, the case before the trial Court is fixed for 01.09.2025 for consideration on charge. Since the trial in aforesaid FIR in question is pending adjudication before the trial Court and speedy trial is a fundamental right of the petitioner enshrined under Article 21 of the Constitution of India, it would be in the interest of justice if the trial Court is directed to expedite the trial in the said FIR.
Accordingly, the present petition is disposed of with a direction to the trial Court to proceed with trial expeditiously, as per law. As now the matter is fixed on 01.09.2025 for consideration on charge, efforts be made by the trial Court to frame the charge on the said date positively.
