Harmesh Dutt Vs. Vidya Dutt RSA No.143 of 2019 14.05.2025 Present: None for appellant. Mr. Ashok Kumar, Advocate, vice Mr. Karan Singh Kanwar, Advocate for the respondent. The appellant is stated to have expired. Mr. Vipin Bhatia, Advocate appearing under instructions of Mr. Servedaman Rathore, Advocate, who was representing the deceased appellant has stated that despite making efforts, legal heirs/legal representatives of deceased appellant are not coming forward to impart instructions and, therefore, no steps for substitution of deceased appellant could be taken. From the above, it appears that legal heirs/legal representatives of the deceased appellant are not interested in pursuing the matter. Accordingly, appeal is dismissed being abated, as well as for non-prosecution, with liberty to the legal heirs/legal representatives of the deceased appellant, but subject to explanation for not taking steps within reasonable time, to approach the Court as permissible under law.
