Today on instructions, learned counsel for the applicant makes a submission that the proceedings under Section 125 of the Cr.P.C. was dismissed for non prosecution before the Family Court, Dehardun, and the applicant would soon be preferring restoration application. Since today, there are no proceedings in the present case, hence the present application has become infructuous. However, learned counsel for the applicant would make a request that in case the maintenance application is restored, then he may be permitted to file a fresh transfer application. 4.
