Also heard Mr. Rajib Saha, learned Addl. P.P. appearing for the respondent- State. The petitioner has filed the instant petition under Section 528 of BNSS, 2023 praying for modification of the order passed by this Court on 09.12.2024 in connection with case No.AB No.63 of 2024 directing the petitioner to pay cost of Rs.25,000/- and also prays for expunging the adverse remarks against the petitioner made in the order dated 09.12.2024. Mr. Saha, learned counsel for the petitioner has submitted that the petitioner was not fully responsible for committing the irregularities while freezing the account in the name of Smt. Pratibha Ghosh Datta, who was the applicant, seeking bail. It is further submitted that the petitioner had joined to the said branch of the bank on 13.06.2024. However, it came to fore that the petitioner himself has frozen the bank account of the bail applicant without following due process of law for which the Court had imposed cost upon him. Moreover, this Court since has become functus officio cannot entertain this petition. Accordingly, the instant criminal petition stands dismissed.
