Neutral Citation No. - 2025:AHC:129019 Court No. - 4 Case :- WRIT - A No. - 6971 of 2025 Petitioner :- Smt. Savita Devi Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Prabha Sehgal,Suresh Yadav Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. Re: Civil Misc. Exemption Application 1. Sri Durgesh Pratap Singh, has appeared in person in compliance of the order of this Court dated 24.07.2025 and states that he has joined as District Program Officer, Deoband Saharanpur only on 25.07.2025 and therefore, there was no delay at his end in forwarding the instruction, if any, prior to his joining to learned Standing Counsel. Explanation offered is accepted. 2. Personal appearance of the officer is exempted. 3. Exemption application is allowed. Order on petition 4. Learned Standing Counsel has obtained instruction in the matter and as per instruction the State Level Committee has already selected the candidates on the post of Principle Server/Mukhya Sevika and the document as appended by the petitioner was only in respect of the verification sought qua the names provided in the list for consideration of selection and appointment. 5. It has been stated in paragraph nos.15 and 16that on 17.05.2023 in the next meeting of State Level Committee the list of selection was finalised and the district came to be allotted subsequently on 19.05.2023. Thus according to the instructions which has been produced in the form of affidavit by the District Program Officer the entire process of selection already stood completed against the post of Mukhya Sevika/Principle Server. 6. In the circumstances therefore, in my considered view the document that has been appended and has been relied upon in the petition to demonstrate that the selection process was still underway looses its relevance and significance. Since the selection has already stood concluded, no mandamus can be issued. 7. Writ petition is dismissed, consigned to records.
