GP FOR HOME 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 36108/2025 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer: “…to issue a Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the Respondents particularly the 3rd respondent in not conducting any investigation and not filing the charge sheet in respect of crime No.54 of 2025 on the file of Anakapalle Rural Police station, Anakapalle Mandal, Anakapalle District, as illegal, arbitrary, contrary to Section 193(9) of BNSS and in violation of the principles of natural justice and the Constitution of India and consequently direct the 3rd respondent to conduct enquiry and submit report/charge sheet to the concerned Hon’ble Magistrate in respect of Crime No.54 of 2025 on the file of the Anakapalle Rural Police Station, Anakapalle Mandal, Anakapalle District.…” 2. Heard Sri Vijaya Kumar Sata, learned counsel for the petitioner and Sri.P.Ajay Babu, learned Assistant Government Pleader for Home for the official respondents. 3. Learned counsel for the petitioner would submit that the respondent No.3 is not conducting any investigation and not filing chargesheet in Crime No.54 of 2025 on the file of the Anakapalle Rural Police Station, Anakapalle Mandal, Anakapalle District. 4. Learned Assistant Government Pleader for Home, on written instructions, would submit that the investigation is still pending since, the offence involves complex financial transactions spread over a long period from the year 2022 to 2024, involving multiple installments, ATM cash deposits, 3 PhonePe transactions, which require detailed scrutiny of all the corroborative documentary evidence. He would further submit that the police sought further time for completing the investigation. 5. Considering the submissions, this Writ Petition is disposed of. However, the respondent-police are directed to conclude the investigation in this matter and file a report according to law as expeditiously as possible. No order as to costs.
