This Writ Appeal, by respondent No.4 before the learned Single Judge, filed under Section 4 of the Karnataka High Court Act, 1961, is directed against order dated 3.4.2024 in WP No.100756/2024, wherein the writ petition filed by respondent No.4 herein was allowed, quashing the selection of respondent No.4 i.e. appellant under Annexure- E, with a direction to the respondents/State to call for fresh applications for the post of Anganwadi worker at Belhod Anganwadi Centre.

2. Heard the learned counsel Sri. Vishwanath Hegde for the appellant; learned Prl. Government Advocate Sri. G.K. Hiregoudar for respondents No.1 to 3 and Sri. Raghavendra P C appearing on behalf of Sri.K.L.Patil,
learned counsel for respondent No.4. Perused the writ appeal papers.
3. The parties would be referred to as they stood before the learned Single Judge for the sake of convenience. The appellant was respondent No.4 and respondent No.4 was the petitioner before the learned Single Judge.

Brief facts of the case are that, respondent No.3 invited applications to fill up the post of Anganwadi Worker at Belhod Anganwadi Centre, Gadag Taluk & District. Respondent No.4 and petitioner applied for the said post. Respondent No.4 was selected as Anganwadi worker and she was appointed under appointment
order dated
2.1.2024. The said appointment of respondent No.4 as

Anganwadi worker to Belhond Anganwadi Centre was challenged by the petitioner in the above Writ Petition No.100756/2024 before the learned Single Judge. The learned Single Judge under impugned order dated 3.4.2024 set-aside the selection and appointment of respondent No.4, solely on the ground that the Residential Certificate of respondent No.4 was cancelled on 17.1.2024. Questioning said order of learned Single Judge, respondent No.4 is before this Court in this writ appeal.

Learned counsel Sri. Vishwanath Hegde for respondent No.4 would submit that cancellation of Residential Certificate by order dated 17.1.2024 was without giving any opportunity to respondent No.4 and respondent No.4, aggrieved by cancellation of Residential Certificate, had filed an appeal before the competent authority. The competent authority by order dated 8.8.2024, set-aside the order of cancellation of Residential Certificate. Therefore, he submits that in view of setting aside the order of cancellation of Residential Certificate,

respondent No.4 would be entitled to continue as Anganwadi worker at Belhod Anganwadi centre.

Per contra, learned counsel for the petitioner would support the order passed by the learned Single Judge and submits that the learned Single Judge directed calling a fresh application and in that view of the matter, he submits that the petitioner would get an opportunity to file an application and participate in the selection process. Therefore, the impugned order passed by the learned Single Judge needs no interference. Thus, it is prayed for dismissal of the writ appeal.
7. Having heard the learned counsels appearing for the respective parties and on a perusal of the entire writ appeal papers, we are of the considered opinion that the
order of the learned single Judge requires interference in the hands of this Court for the following reasons.
8. A perusal of the learned single Judge’s order makes it abundantly clear that, learned single Judge

quashed the selection of respondent No.4 under selection list dated 07.12.2023, solely on the ground that her residential certificate has been cancelled by the Tahasildar, Gadag. Now that the order of cancellation of residential certificate is set aside by order dated 08.08.2024 by appellate authority, which order is placed on record along with a memo dated 10.10.2025. Therefore, the order under appeal needs interference. When once cancellation of residential certificate is set aside in appeal by the Assistant Commissioner, by order dated 08.08.2024, the residential certificate of respondent No.4 gets revived. In the above said circumstances, we pass the following:
ORDER i) Writ appeal is allowed. ii) The order dated 03.04.2024, passed in W.P.No.100756/2024 (S-RES), by this Court, is set aside.

iii) Consequently, W.P.No.100756/2024 stands rejected.
