1. Applicant seeks regular bail in FIR No. 486/2024 for commission of offences under Sections 419/420/120B/34 IPC, registered at Police Station Prashant Vihar. 2. The case of the prosecution is based on report lodged by concerned complainant i.e. Vikas Jindal who has, in his report, given the manner in which he has been cheated by the accused persons. 3. According to him, the complainant and his wife knew Ms. Sudarshini Ray, who was a practicing advocate. Complainant is a Vastu Shastra practitioner and in the year 2018, Ms. Ray contacted him to seek some Vastu advice. She, eventually, hatched a conspiracy with the present applicant and in terms of such conspiracy, they both played fraud. In order to achieve illegal objective, the applicant herein posed as Assistant Commissioner, Narcotics at Banglore and apprised the complainant that he was relative of son of Union Cabinet Minister and that he had strong connections in the governmental This is a digitally signed order. departments. He assured the complainant that he would be helpful in providing contracts of Canteens etc. in Government Offices. Based on such assurance, the complainants paid him a sum of Rs. 88,00,000/-. 4. The applicant was, eventually, arrested on 15.01.2025 and is in continuous incarceration since then, albeit, his co-accused i.e. Ms. Ray, is stated to be on anticipatory bail. She was never arrested and in the interregnum, a chargesheet had been filed against the accused persons. 5. The case is, reportedly, at the stage of arguments on charge and the next date before the learned Trial Court is stated to be 07.09.2026. 6. According to learned counsel for applicant, the applicant is victim of circumstances and he never made any such misrepresentation to the complainants.
He submits that the applicant was merely working in the office of his alleged co-accused and has been made a scapegoat in the present case. 7. Fact, however, remains that allegations are specifically against him and substantial amount was transferred by complainant in his bank account only. 8. Learned APP for the State submits that such amount has been spent by the applicant as he purchased a property, renovated the same and also bought a car. He also took assistance of one lady who assisted them, in the abovesaid fraudulent inducement as she used to assure the complainants that their work would be done. 9. Though, the period of incarceration of the applicant is of around 1 ½ years, fact remains that the case is still at initial stage as charges are yet to be ascertained. 10. In view of the above, at this juncture, this Court does not find any compelling reason to enlarge him on bail. He would be, however, at liberty to file application afresh, once the charges are ascertained. This is a digitally signed order. 11. The application is, accordingly, dismissed, with the above liberty. 12. It is, however, clarified that the observations made hereinabove are tentative in nature and would not prejudice the mind of the learned Trial Court while ascertaining charges. MANOJ JAIN, J
