For the reasons stated therein, the application is allowed, and the captioned petition is taken on Board. The application therefore stands disposed of. By way of this petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner assails an order of the Magistrate’s Court dated 24.07.2025, by which charges have been framed against him under Sections 498A/34 of the Indian Penal Code, 1860 [“IPC”], in This is a digitally signed order. After some arguments, Mr. Namit Suri, learned counsel for the petitioner, seeks permission to withdraw this petition, without prejudice to the petitioner’s rights to move the Revisional Court against the impugned order. Mr. Suri submits that the petitioner also reserves his right to seek condonation of delay before the Revisional Court, in view of the fact that the present petition has been pending in this Court since 10.10.2025. Mr. Suri further submits that in the event, the petitioner is unsuccessful before the Revisional Court, all his rights and remedies be reserved. 3. The petition, alongwith pending applications, is dismissed as withdrawn, in terms of the aforesaid submissions. 4. It is made clear that this Court has not entered into the merits of the matter, and all rights and contentions of the parties, both on merits and with regard to condonation of delay application, if any, may be agitated before the Revisional Court, and decided in accordance with law. 5.
