CORAM : SRI ANANDA SEN, J. ----- For the Petitioner(s) : Mr. Awnish Shanker, Advocate. For the State : Mr. Manoj Kumar Mishra, A.P.P. -----
02/ 07.03.2025
The petitioner is praying for grant of bail as she is in custody in connection with Mohammadganj P.S. Case No.31 of 2017, G.R. Case No.1764 of 2017 corresponding to S.T. Case No.366 of 2017, for allegedly committing offences punishable under Sections 304(B) and 302/34 of the Indian Penal Code, pending before the Court of Additional Sessions Judge-V, Palamau at Daltonganj.
2. Heard the learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order.
3. The application of this petitioner for grant of regular bail was earlier rejected by this Court vide order dated 26.03.2018 passed in B.A. No.742 of 2018.
4. The petitioner is the lady who is renewing her prayer for bail during pendency of the trial. It is true that if the trial is at the fag end the Court should be very cautious in granting bail. Now the fact which cannot be lost sight of, is that for seven years the trial has not concluded even investigating officer has not been examined. The last witness examined in this case was on 18.03.2024. Since last one year the State has failed to produce any other witness. Though the trial is at the fag end but considering the aforesaid state of affairs and since the petitioner being the lady and has remained in custody for seven years, I am inclined to release the petitioner on bail.
5. Accordingly, the present Bail Application is allowed. The petitioner, named above, is directed to be released on bail on
