JUSTICE PARTHA SARTHY ORAL ORDER 5 02-09-2025 1. The petitioner has filed the instant writ application for the following relief :- “1. That, the petitioner craves indulgence of this Hon’ble court for issuance of an appropriate writ in the nature of Certiorari for quashing the order dt. 7.3.2013/16.4.2013 passed by respondent no.2 in Misc. Appeal no. 409/12 as contained in annexure-8 whereby and Patna High Court CWJC No.15934 of 2013(5) dt.02-09-2025 2/2 whereunder respondent no.2 has been pleased to reject the appeal of the petitioner and did not interfere in the order passed by respondent no. 3 vide memo no.931 dt. 17.5.2012 as contained in annexure-6 and further for directing the respondents to consider the case of the petitioner on the bassis of the fresh materials available on the record for appointment on compassionate ground.” 2. At the outset, it was submitted by learned counsel appearing for the State of Bihar that on the death of the father of the petitioner in the year 2004, the matter was pursued by the petitioner till his writ application CWJC no.1719 of 2009 was rejected on 3.2.2009. This order attained finality as no appeal etc. was preferred against the same. Now after so many years in the year 2013 once again, the petitioner has preferred this writ application for the relief as stated herein above. 3. After having heard the observation of this Court, learned counsel for the petitioner seeks permission to withdraw this application. 4.
