Heard the parties.
The petitioners have been made accused in connection with Sessions Trial No.71 of 2022, arising out of Dumka (M) P.S. Case No.221 of 2021, for the offences registered under Sections 341, 323, 354, 328, 379, 504, 506, 411, 302/34 of the I.P.C., pending in the Court of learned Additional Sessions Judge-IV, Dumka.
Bail application of the petitioners was earlier rejected by a Co- ordinate Bench of this Court vide B.A. No.6316 of 2023 by order dated
03.11.2023.
Petitioners are alleged to have forced the brother of the informant namely Vikash Kumar Sah to consume poison. The petitioners and co- accused persons also assaulted him due to which he succumbed to his injuries.
It was submitted that petitioners are in custody since 17.11.2021 and 20.11.2021 respectively. It was further submitted that out of 10 charge sheeted witnesses, only 8 witnesses have already been examined.
Considering the nature of allegation and the fact that the trial is at the fag end of its conclusion, I am not inclined to release the petitioners, on bail. Accordingly, their prayer for bail stands rejected.
Learned trial court shall expedite the trial.
