HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. BAIL APPLICATION No. - 18624 of 2025 Court No. - 65 HON'BLE DR. GAUTAM CHOWDHARY, J.
1. Supplementary affidavit filed today is taken on record. 2. Heard learned counsel for the applicant, learned A.G.A. for the State as well as learned counsel for the informant and perused the record. 3. Learned counsel for the applicant submits that there is allegation against the applicant that he committed rape of the daughter of the informant, but during course of trial the victim (P.W.2) in her testimony deposed at the trial has not supported the prosecution case and she has been declared hostile, which statement has been filed as Annexure No. S.A.1 to the supplementary affidavit filed today. Thus, it is argued that there is bleak chance that prosecution may prove its case beyond reasonable doubt and the applicant may be convicted. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed before the Court. The circumstances which, according to the counsel, led to the false implication of the accused have also been mentioned. It has also been assured on behalf of the applicant that he is ready to cooperate with the process of law and shall faithfully make himself available before the court whenever required and is also ready to accept all the conditions which the Court may deem fit to impose upon him. He next submits that applicant is languishing in jail since 08.03.2025. 4. Per contra, learned A.G.A. as well as learned counsel for the informant have opposed the prayer for bail of the applicant by contending that innocence of the applicant cannot be adjudged before conclusion of trial, therefore, he does not deserve any indulgence, but he has not disputed that the victim in her testimony has not supported the prosecution case during the course of trial and she has been declared hostile. 5.
