This is the second bail application of the applicant. The first bail application of the applicant has been dismissed vide order dated 14.11.2024, passed in MCRC No. 5721 of 2024. The applicant is in jail since 22.07.2023 in connection with Crime No. 374 of 2023, registered at Police Station Basna, District Mahasamund (C.G.) for the offence punishable under Sections 363, 366, 376(2)(n), 376(3) of the Indian Penal Code and Sections 4 and 6 of Protection of Children from Sexual Offences Act, 2012 (in short ‘POCSO Act’). 2. At the outset, learned counsel appearing for the applicant would pray for withdrawal of the present bail application, however, he would submit that, out of 20 cited witnesses, only 11 witnesses have been examined till date and the applicant is in jail since 22.07.2023, VED PRAKASH DEWANGAN Digitally signed by VED PRAKASH DEWANGAN Date: 2025.11.24 17:44:08 +0530 2 therefore, the learned trial Court may be directed to expedite the trial of the case and to conclude the same as early as possible. 3. The submissions made by learned counsel for the applicant is not opposed by the State counsel. 4. Considering the submissions made by learned counsel for the parties, the present bail application is dismissed as withdrawn. However, considering the detention period of the applicant that, he is in jail since 22.07.2023, the learned trial Court is directed to expedite the trial of the case and to conclude the same as early as possible.
