2. This is first bail application before this Court filed by the applicant for grant of regular bail. The applicant has been arrested on 04.09.2025 in connection with Crime No.205/2025 registered at Police Station Hirri, District Bilaspur (C.G.) for the offence under Sections 137(2), 87, 64(m) of BNS, Section 4 and 6 of the POCSO Act.
3.
Brief facts of this case are that on 01.09.2025, father of the victim lodged a missing report that her minor daughter is missing since
31.08.2025. The police has registered the offence under Section 137(2) of B.N.S. and started investigation. During investigation, the victim and the applicant appeared before the police station and after recording statement of the victim, other offence under Section 87, 64(m) of BNS and Section 4 & 6 of the POCSO Act have been added and the applicant has been arrested on 04.09.2025 and charge-sheet has been filed. Hence this bail application.
4.
Learned counsel for the applicant would submit that the applicant is innocent and he has falsely been implicated in the alleged crime, he has not committed any offence as alleged against him. He further contended that the victim is a major girl having love affair with the applicant and there are three date of birth available in the charge-sheet and according to her ossification report, she is aged about 16 to 18 years. Both, victim and the applicant had gone Raipur and perform the marriage in the Arya Samaj Mandir and since her father has already lodged a missing report on 01.09.2025, both of them had gone before the police station to inform about their status that they have married
3 each other, however, the police has already registered the offence in which the applicant has been arrested. He would further submit that the victim was having love affair with the applicant and she on her own will, has eloped with the applicant and she has not raised any alarm when she was allegedly eloped with the applicant. The investigation has been completed and charge-sheet has been filed and the applicant is in jail in since 04.09.2025 and continued detention will caused undue hardship to his family and serve no useful purpose as the trial may take considerable time. 5. Per contra, learned counsel for the State as well as Objector oppose the bail application submitted by the applicant. 6. I have heard learned counsel for both the parties, perused the case diary and other materials available on record. 7. Considering the submissions made by learned counsel for the parties, considering the nature of allegation and the material collected during the investigation, further considering the variants in date of birth of the victim in three different documents, the fact of their marriage at Arya Samaj Mandir at Bilaspur which is available in the charge-sheet and also after gone through her statement under Section 183 of BNSS, 2023 without commenting anything on merits, I am inclined to release the applicant on bail. 8. Consequently, the bail application filed by the applicant – Raj Singh Thakur @ Ravindra Singh Thakur for grant of regular bail is hereby
4 allowed. It is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.
25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, on following conditions: (i) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court.
