Present writ petition has been filed with the prayer to quash the impugned first information report dated 6.3.2025 as Case Crime No. 63 of 2025 at P.S. Rampur Maniharan, District Saharanpur, under Section 109, 324(4), 61(2) BNS. Further prayer has been made not to arrest the petitioner in aforementioned case. 3. Petitioner is not named in the first information report. 4. On preliminary objection as to how present petition is maintainable in the light of judgement passed in SLP (Criminal) No. 762 of 2020 (Hukum Chand Garg and others vs. State of U.P. and others) decided on 7.2.2022, learned counsel for the petitioner submitted that he may be permitted to withdraw the present petition with liberty to the petitioner to avail remedy as may be available to them in accordance with law. 5. Accordingly, present petition stands dismissed as withdrawn with liberty aforesaid. 6. Office is directed to return the certified copy of the first information report to learned counsel for the petitioner after obtaining photocopy of the same within two working days.
