ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“.... a Writ of Mandamus declaring the action of Respondent No. 3 and their staff interfering and trying to dispossess the petitioner from the private land to an extent of Ac.7.42 Cents out of Ac.8.20 Cents in Sy. No. 13/2 of Ramayogi, Agraharam Village, Bheemunipatnam Mandal, Visakhapatnam District and consequently direct the respondent No.3 and their staff not to interfere and dispossess the petitioner from a private land to an extent of Ac.7.42 Cents out of Ac.8.20 Cents in Sy. No. 13/2 of Ramayogi, Agraharam Village, Bheemunipatnam Mandal, Visakhapatnam District.”
2. Ms.D.Gayathri, learned counsel for the Petitioners would submit that, it is a case of interference of Police in the civil matter. Learned counsel would further submit that, under the influence of the unofficial Respondents, the Police are trying to dispossess the Petitioners from the subject property. 3. Sri P.Ajay Babu, learned Assistant Government Pleader for Home would submit that the Police neither interfered in the civil disputes between the parties nor pressurized the Petitioners to vacate the subject land. 4. Sri S. Kaleemulla, learned counsel for the unofficial Respondents is in attendance. 5. Considering the submissions made, the Writ Petition is disposed of.
However, Police are directed not to interfere with the civil disputes between the parties, except under due process of law. There shall be no order as to costs.
