JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 2 11-08-2025 Heard learned counsel for the petitioners and learned APP for the State. 2. The petitioners seek regular bail in connection with Banmankhi Rail P.S. Case No. 05 of 2025 registered for the offence punishable under Sections-305(c), 317(2), 317(5), 3(5) of BNS. 3. According to FIR, the accused persons snatched away Jitiya and Mangalsutra from the neck of the informant, Ranjan Devi when she was travelling by Train No. 72558. The petitioners were arrested and a golden Jitiya was recovered from the petitioner No. 1. So far petitioner Nos. 2 to 4 are concerned, Patna High Court CR. MISC. No.47999 of 2025(2) dt.11-08-2025 2/2 mobile sets were recovered from their possession. 4. Learned counsel for the petitioners has submitted that they are innocent and have falsely been implicated in this case. They are the persons of clean antecedent and they are under custody since 20-05-2025. 5. Learned counsel appearing for the State has opposed the prayer for bail. 6. Considering the aforesaid facts and circumstances, specially the clean antecedent and period of custody, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Khagaria in connection with Banmankhi Rail P.S. Case No. 05 of 2025. 7. Before accepting the bail bonds, the criminal antecedent of the petitioners shall be verified and if, it is found that they are involved in any other case except the case(s), mentioned in paragraph-3 of the bail petition, their bail bonds shall not be accepted.
