JUDGMENT:(Per Hon’ble Sri Justice Battu Devanand) This Writ Appeal has been filed against the order, dated 11.01.2024 in Writ Petition No.33504 of 2010 passed by the learned Single Judge of this Court.
2. At the stage of admission of this Writ Appeal, the co-ordinate Bench of this Court passed
order, dated 09.07.2024 permitting the respondents to reconsider the case of the appellant/petitioner, in the light of the proviso to Regulation 19(2A) (a) (iv) of LIC (Staff) Regulations, 1960.
3. Pursuant to the same, the respondents has passed order, dated 28.11.2024 wherein it is informed to the petitioner that the respondents do not find any merit in reconsidering the case of the appellant/petitioner for allowing withdrawal of his voluntary retirement request and the same is rejected.
4. During the course of hearing of this appeal, today learned counsel on either side brought to the notice of this Court that aggrieved by the Proceedings, dated 28.11.2024 issued by the respondents, the appellant has approached this court by filing W.P.No.3524 of 2024 and it is pending. But by
order dated 09.12.2024, learned Single Judge of this Court directed the registry to post that writ petition along with this Writ Appeal.
5. Having considered the facts and circumstances of the case, we are of the considered view that in the light of the order, dated 28.11.2024 passed by respondents, pursuant to the interim order, dated 09.07.2024 passed by the co-ordinate Bench of this Court, the Writ Appeal has become infrucutous.

As already the Proceedings, dated 28.11.2024 are challenged by the appellant in Writ Petition No.3524 of 2024, in our view, it is appropriate and desirable that it is to be heard by the learned Single Judge in accordance with law and to pass appropriate orders. If that Writ Petition is heard by this Bench, the parties of the Writ Petition have to loose an opportunity of appeal before this Court.
7. For the aforesaid reasons, the Writ Appeal is dismissed as infructuous.
