DISTRICT AND SESSIONS JUDGE GADAG, IN KID NO.1/2020 VIDE ANNEXURE- B IN THE INTEREST OF JUSTICE AND EQUITY. 2 THIS WP COMING ON FOR CONCILIATION BEFORE LOK ADALAT AFTER BEING REFFERED BY THE COURT, THE FOLLOWING CONCILIATION ORDER IS PASSED: CONCILIATION ORDER The Management of NWKRTC, is before this Court seeking a writ of certiorari or any other appropriate writ, order or direction to set aside the order dated 03.09.2024 passed by the Additional District and Sessions Judge, Gadag in K.I.D.No.1/2020 (Annexure-B), wherein, Industrial Dispute filed by the respondent-workman is allowed by setting aside the order of dismissal/removal dated 21.11.2019 passed by the Corporation. 2. The parties to the lis have amicably resolved their dispute before the Lok Adalat and to that effect, they have filed joint memo of settlement. The terms of settlement read as under: 1. The Petitioner Corporation has challenged the legality and correctness of the orders of the Hon'ble Labour Court, Gadag in KID No.01/2020. The Respondent was the Driver in the Petitioner Corporation and he was dismissed from service vide order dated 21/11/2019 in an abseentism case. The Respondent workman has challenged the said dismissal order in KID No.01/2020 before the Labour Court, Gadag. On detailed adjudication, the Labour Court directed the Petitioner 3 Corporation to re-instate the Respondent workman back into service with all service benefits from date of dismissal till reinstatement by order dated 03.09.2024. Being aggrieved with the said orders, the Corporation filed present W P. No.109709/2025 before this Hon'ble High Court. The Petitioner Corporation re-instated the Respondent workman subject to the result of the present Writ Petition. On detailed discussions both the petitioner and the Respondent and their counsels have decided to enter into compromise on the following terms. 2. The Petitioner Corporation agreed to the terms that the Respondent workman deemed to have been re-instated as on his re-instatement made by the Petitioner Corporation subject to the result of the present Writ Petition. 3. The Respondent workman is not entitled to continuity of service, consequential benefits, and back wages from the date of dismissal till his actual re-instatement. 4. The settlement has been entered into in the interest of both the parties and without any duress or force. The settlement is fair, legal and reasonable also. 3. The joint memo of settlement is placed on record. 4. It is stated that the respondent-workman has been reinstated into service. The respondent- workman is not entitled for continuity of service, consequential benefits and backwages from the date of dismissal till his actual reinstatement. From the 4 date of reinstatement, the respondent-workman is deemed to have been continued in service. 5. The writ petition stands disposed of in terms of the compromise/settlement arrived at between the petitioner/NWKRTC and respondent- workman. Sd/- JUDGE Sd/- MEMBER NC. CT:VP 5 6
