Learned counsel appearing for the applicant submits that merely on the ground that the applicant was earlier declared a Proclaimed Offender [PO], his application has been rejected by the Trial Court for grant of bail. According to him, the applicant has suffered more than one year of incarceration and, therefore, he is entitled for grant of bail on merits.
2. The Court finds that the order dated 04.10.2025 passed by the Trial Court does not deal with the case on merits. The applicant claims parity with the co-accused, who has already been granted bail.
3. Though the applicant was declared PO, he has already suffered about one year of incarceration, the same, at this stage, should not be the sole This is a digitally signed order. 4. The Court, however, finds it appropriate to direct the Trial Court to consider imposing reasonable conditions securing the applicant’s presence during the course of trial if the applicant otherwise is entitled for grant of bail on merits.
5. With these observations, the application stands disposed of with liberty to approach the Trial Court.
