JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 2 01-08-2025 Heard Ms. Jyoti Kumari, learned counsel for the petitioners and Mrs. Asha Devi, learned APP for the State. 2.The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Khirimore P.S. Case No. 139 of 2024 instituted for the offence under Sections 105 and 3(5) of B.N.S. 3. The case of the prosecution is that the son of the informant was going to his field where he was electrocuted. It is alleged that the petitioners along with others were running their tubewells with nude wires in connivance with Electricity Department due to which son of the informant was electrocuted. 4. Learned counsel appearing on behalf of the Patna High Court CR. MISC. No.46492 of 2025(2) dt.01-08-2025 2/3 petitioners has submitted that petitioners are innocent and have committed no offence. They have falsely been implicated in this case. There is no direct allegation against these petitioners. It has also been submitted that parties have entered into compromise as they have come to know about the truth. It has also been submitted that in the trial of the one of the accused the informant has deposed before the trial Court and has stated in his cross-examination that on the date of the occurrence co- villagers were saying that his son has got electrocuted and on the basis of that information, he has filed the case. He has also stated that later on he came to know that these petitioners have not committed any occurrence and for that he has compromised. Petitioners are having no criminal antecedent. 5. Learned APP appearing for the State has vehemently opposed the prayer of bail of the petitioners. 6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Khirimore P.S. Case No. 139 of 2024, they will be enlarged on bail on furnishing bail bond of Patna High Court CR. MISC. No.46492 of 2025(2) dt.01-08-2025 3/3 Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Danapur, Patna, subject to the conditions as laid down under section 482 (2) of the B.N.S.S. lata/- (Ashok Kumar Pandey, J) U T
