The present Habeas Corpus Writ Petition has been filed with a prayer to issue a Habeas Corpus directing and commanding the respondents to produce the corpus/detainee before this Hon'ble Court, within the time fixed by this Hon'ble Court and this Hon'ble Court after recording their statements set them at liberty. At the very outset, learned counsel for the petitioner wants to withdraw the present petition. However, he seeks liberty to avail appropriate remedy under Section 9 of Hindu Marriage Act for the Restitution of Conjugal Rights. Accordingly, the Habeas Corpus Writ Petition is dismissed as withdrawn with liberty as aforesaid.
