On 23.10.2023 at about 6:30 P.M., quarrel ensued over drinking of liquor between the accused persons and informant party due to which one Babulal Das succumbed to his injuries. It was submitted that as far as petitioner is concerned, there is no allegation that he has assaulted Babulal Das. It was further submitted that similarly situated co-accused Birju Das, Pawan Das @ Pawan Kumar, Chandrika Das and Mitan Das have been granted bail by a Co-ordinate Bench of this Court. Mr. Sumit Prakash, learned counsel for the informant has vehemently opposed the prayer for bail. It appears that there is case and counter case between the parties with regard to the same occurrence. In view of the aforesaid facts, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned C.J.M., Giridih, in connection with Bengabad P.S.
