The present petition has been filed for the following relief:- "i) issue, a writ, order or direction in the nature of mandamus restraining the respondents from raising any construction on street ad measuring area 8 fit 40 fit and on its footpath situated at the western side of the house of petitioner bearing House No.76/3 Halsi Road, Kanpur Nagar and to remove the construction raised forthwith and on within specific period as fixed by this Hon'ble Court." The petitioner has the remedy to approach the Civil Court for appropriate relief and it is not a case to take cognizance under Article 226 of the Constitution of India at this stage.
