GP FOR SERVICES I The Court made the following: 2 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 36174/2025 The present Writ Petition is filed seeking a direction to the Respondents to promote the Petitioner notionally to the post of Assistant Geologist with effect from 26.05.2020. 2. The Petitioner is working as Assistant Geologist. A Charge sheet was issued against the Petitioner on 28.03.2013 with regard to alleged misconduct while working as Royalty Inspector at integrated check post, B.V. Palem, Tada (M). After the enquiry, the charges against the Petitioner were dropped vide Memo No.2456/Vig/A1/2013, dated 01.06.2021. In the interregnum, according to the Petitioner, he should have been promoted to the post of Assistant Geologist with effect from 26.05.2020. But, on account of Departmental Proceedings, the Petitioner was not promoted as Assistant Geologist from 04.07.2022. As the Departmental Proceedings are dropped, the Petitioner claims promotion to the said post with retrospective effect. Representations were also given by the Petitioner seeking consideration of similar benefit and the same was not considered, the present Writ Petition is filed. 3 3. Learned Assistant Government Pleader submits that the case of the Petitioner would be considered as per rules and from the date of promotion of his junior. 4. Heard the respective counsel. 5. Considering the submissions made, the Writ Petition is disposed of with the following directions: i) The Respondents are directed to consider the representation of the Petitioner dated 20.09.2025 and pass appropriate orders thereon as expeditiously as possible. ii) There shall be no order as to costs.
