Neutral Citation No. - 2025:AHC:81412 Court No. - 5 Case :- WRIT - A No. - 6781 of 2025 Petitioner :- Rahul Ranjan Kumar Respondent :- State Of U.P. And 8 Others Counsel for Petitioner :- Pranesh Kumar Mishra Counsel for Respondent :- Abhishek Srivastava,C.S.C.,Kartikeya Saran Hon'ble Ajay Bhanot,J. The petitioner claims that he is entitled to promotion to the post of Assistant Engineer (E&M). He has made a representation before the competent authority but to no avail. The only prayer made by Shri Pranesh Kumar Mishra, learned counsel for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time. Ms. Kritika Sinha, learned counsel holding brief of Shri Abhishek Srivastava, learned counsel for the respondents No.2, 3, 4 and Shri Jigar Khare, learned counsel holding brief of Shri Kartikeya Saran, learned counsel for the respondent No.5 submit that the matter requires determination of facts by the competent authority in light of the applicable provisions of law in the first instance. However, they fairly contend that his claim for promotion to the post of Assistant Engineer (E&M) is liable to be decided by the competent authority in a reasonable time frame. In wake of the submissions made at the Bar and without going into the merits of the case, the Chairman, U.P. Power Corporation Ltd., Lucknow/respondent No.2 and Chief Engineer (Hydel), U.P. Power Corporation Ltd. Lucknow/respondent No.3 are directed to decide the representation of the petitioner regarding his promotion to the post of Assistant Engineer (E&M) after noticing all necessary parties in accordance with law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally disposed of.
