ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue a appropriate writ, Order or direction, particularly a Writ of Mandamus declaring the inaction of the respondent No.3 on petitioner's complaint dated 15.12.2025 to take action against the 4th respondent for trespassing, as illegal, irregular and arbitrary, violative of Articles 14 and 21 of Constitution of India and consequently direct the 3rd respondent to initiate necessary action upon the complaint of the petitioners against the 4th respondent for trespassing their house and attacking them at their house on 14.12.2025.…”
2. Heard Sri M.Solomon Raju, learned counsel for the petitioners and Sri.P.Ajay Babu, learned Assistant Government Pleader for Home for the official respondents.

Learned counsel for the petitioners would submit that the grievance of the petitioners is that the respondent-police are not taking any action on their complaint made against the 4th respondent.
4. Learned Assistant Government Pleader for Home, on written instructions would submit that the respondent-police have not received any written complaint from the petitioners. He would further submit that the subject matter is relating to matrimonial and family disputes between the petitioners and unofficial respondent. Learned Assistant Government Pleader for Home, would further submit that a case in Cr.No.135 of 2023 under Section 498-A IPC was registered against the petitioners and the same is pending for Trial

vide C.C.No.974 of 2023, apart from M.C.No.66 of 2023. He would further submit that the petitioners herein made an oral complaint, for which, the respondent-police have conducted discreet enquiries, which reveal that the subject matter is matrimonial disputes between the parties. Therefore, they are not interfering in the same, since, no cognizable offence is there and advised the parties to resolve their issues before the appropriate forum.
5. Considering the submissions, this Writ Petition is disposed of. However, the petitioners are at liberty to work out their remedies before the appropriate forum according to law. No order as to costs.
