The instant application under section 482 Cr.P.C. has been filed seeking quashing of the order dated 17.1.2025 by which the application 39Kha filed by the applicant in respect of summoning the record of Case No. 09462 of 2021 (State Vs. Dheeraj Digani) arising out of Case Crime No. 725 of 2020 under section 307/34 IPC police station Brahmpuri District Meerut. 3. Learned counsel for the applicant submits that with regard to Case Crime No. 725 of 2020 initially a charge sheet no. 114 of 2021 under section 307/34 IPC was filed on 4.5.2021 and in the said case the proceedings are still pending before the Addl. C.J.M. Court No. 7 Meerut for committal whereas the subsequent charge sheets filed after further investigation in the matter being 114A/22 and 114B/22 on 1.4.2022 and 15.6.2022 respectively, in which the committal has already taken place and the trial is already in progress and the P.W. 1 has already been examined and at the stage of cross examination, an application was filed, calling for the records of the case of the initial charge sheet. The said application has been rejected by the impugned order dated 17.1.2025 by the trial court. On 12.6.2025 a coordinate Bench of this Court passed the following order: "Learned Additional Government Advocate, will seek instructions in the matter within a week indicating why two charge-sheets have been filed in the same case, and, if so, why these two should not be consolidated. Lay as fresh on 19.06.2025. Let this order be communicated to the learned Chief Judicial Magistrate, Meerut by the Registrar (Compliance) within 48 hours." 4. Pursuant to which the report dated 18.6.2025 has been submitted by the CJM Meerut, which reads as under: "उपररोक्त कके सम्बन्ध मम, ममानननीय महरोदय करो समादर अवगत करमानमा हहै ककक- (1)- ममुकदममा अपरमाध ससं०-725/2020 मम सवरप्रथम अकभियमुक्त जमाककर, सरोननू उरर ररयमाजमुददनीन कके कवरुद्ध जनूमर समाकबत हरोनके पर कदनमासंक 04.05.2021 करो आररोप पत्र ससं 0-114/2021 अन्र्तगत धमारमा 307,34 भिमा०द०स० मम प्रकेकषित ककयमा गयमा। जरो ककमटल कके स्तर पर अपर ममुख्य न्यमाकयक मजजस्टर्केट, न्यमायमालय ससं०-7 मकेरठ मम कवचमारधनीन हहै। (2)- उसकके उपरमान्त वररष्ठ पमुजलस अधनीक्षक मकेरठ कके आदकेश दमारमा 173(8) मम अकग्रिम कववकेचनमा कके आदकेश पमाररत ककयके गयके और उक्त समस्त कववकेचनमा कके आधमार पर अकभियमुक्त यशपमाल तरोमर व तसलनीम कके कवरूद्ध जनूमर समाकबत हरोनके पर अन्तरगत धमारमा 307,120 बनी मम आररोप पत्र स०-114 ए/2022 कदनमासंक 01.04.2022 करो प्रकेकषित ककयमा गयमा तथमा अकभियमुक्त धनीरज कडिगमाननी कके कवरूद्ध कववकेचनमा प्रचजलत रखनी गयनी। जजसकमा सत्र परनीक्षण ससंख्यमा -71/2023 हहै। जरो समाक्ष्य कके स्तर पर अपर जजलमा एवसं सत्र न्यमायमालय करोटर ससं०-5 मकेरठ मम कवचमारमाधनीन हहै। (3)- पमुनक समस्त कववचकेनमा उपरमान्त अकभियमुक्त धनीरज कडिगमाननी कके कवरुद्ध जमुमर धमारमा 307,120 बनी भिमा०द०ससं० कमा हरोनमा गयमा और उक्त अकभियमुक्त कके कवरुद्ध आररोप पत्र स० - 114 बनी/2022 कदनमासंक 15.06.2022 करो प्रकेकषित ककयमा गयमा और कववकेचनमा सममाप्त ककी गयनी। जरो समाक्ष्य कके स्तर पर अपर जजलमा एवसं सत्र न्यमायमालय करोटर ससं०-5 मकेरठ मम कववमारमाधनीन हहै। (4)- इस प्रकमार समस्त अकभियमुक्तगणणों कके कवरुद्ध कमु ल तनीन आररोप पत्र कभिन-कभिन समयकमाल मम उपलब्ध समाक्ष्यणों कके आधमार पर तथमा वररष्ठ पमुजलस अधनीक्षक मकेरठ कके अकग्रिम कववकेचनमा कके आदकेश कके रलस्वरूप अकभियमुक्तगण ककी भिनूकमकमा करो पमातके हहयके प्रकेकषित ककयके गयके। जजसमम सके प्रथम आररोप पत्र ककमटल कके स्तर पर अपर ममुख्य न्यमाकयक मजजस्टर्केट, न्यमायमालय ससं0-7 मकेरठ मम कवचमारमाधनीन हहै, तथमा कदतनीय व ततृतनीय आररोप पत्र समाक्ष्य कके स्तर पर अपर जजलमा एवसं सत्र न्यमायमालय करोटर ससं०-5 मकेरठ मम कवचमारमाधनीन हहै। उक्त पत्रमावलनी मम ममौजनूद आदकेश कदनमाककत 03.07.2023 कके अवलरोकन सके दकशरत हहै, कक सत्र परनीक्षण स०-71/2023 व सत्र परनीक्षण 79/2023 करो एकजमाई ककयमा जमा चमुकमा हहै। जजसमम सत्र परनीक्षण ससं 0-71/2023 अग्रिणनी वमाद रहकेगमा। यमाकचकमाकतमार कमा सम्बन्ध सत्र परनीक्षण ससं0-79/2023 सके हह, जरो कक 71/2023 कके समाथ पनूवर मम हनी एकजमाई हरो चमुककी हहै और उक्त दरोनणों बमाद समाक्ष्य कके स्तर पर लमम्बत हहै। अनमुपमालन आख्यमा ममानननीय महरोदय कके अवलरोकनमाथर एसंव आवश्यक कमायरवमाहनी हकेतमु समादर प्रकेकषित हहै।" 5. From the aforesaid report it is apparent that against the initial charge sheet submitted the proceedings are still pending before the Magistrate for committal. However, no reason has been assigned as to why the case has not yet been committed to the court of sessions. 6. In view thereof it is hereby directed to the Addl. C.J.M. Court No. 7, Meerut to commit the case arising out of the charge sheet no. 114 of 2021 against Zakir and Sonu alias Riyazuddin for the offence under section 307/34 IPC arising out of case crime no. 725 of 2020 to the session court within two weeks from the date production of the certified copy of this order, if there is no legal impediment and on such committal the said case shall be clubbed with the Session Trial No. 71 of 2023 as well as 79 of 2023. 7.
