1. None appears nor is any representation made on behalf of the applicant to press this bail application when the case is called out. 2. It transpires from the record that the applicant is in jail since
23.10.2024. Hence, the Court proceeds to consider and hear the bail application of the applicant with the assistance of the State counsel. 3. This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.
2 142/2018 registered at Police Station – Sarkanda, District Bilaspur (C.G.), for the offence punishable under Sections 420, 467, 468, 471, 120-B and 34 of the Indian Penal Code. 4. The prosecution's case, in brief, is that the complainant filed a written complaint with the police station, alleging that the accused persons created forged documents and executed a registered sale deed for a land parcel in the complainant's favor. Based on this complaint, the police registered an offense under Sections 420, 467, 468, 471, 120-B, and 34 of the Indian Penal Code (Crime No. 142/2018) against the present applicant and other accused persons. 5. Learned State counsel opposes the bail application of the present applicant and submits that in the present matter the charge-sheet has already been submitted before the competent Court. She further submits that the bail of other co-accused person, namely, Narendra Tandon in MCRC No. 8375 of 2024 has already been rejected by this Hon’ble Court, vide order dated 22.01.2025, therefore, the bail application of the present applicant is also entitled to be rejected. 6. I have heard learned counsel appearing for the parties and perused the case diary. 7.
Considering the facts and circumstances of the case and the fact that the bail of other co-accused person, namely, Narendra Tandon in MCRC No. 8375 of 2024 has already been rejected by this Hon’ble Court, vide order dated 22.01.2025 and the case of the applicant is no way different to the said co-accused person,
3 therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on bail. 8. Accordingly, the bail application of the applicant – Ramprasad Banjare, filed under Section 483 of the BNSS, involved in Crime No. 142/2018 registered at Police Station – Sarkanda, District Bilaspur (C.G.), for the offence punishable under Sections 420, 467, 468, 471, 120-B and 34 of the Indian Penal Code, is rejected. 9. After the order passed Mr. Ashok Dixit, learned counsel for the present applicant appeared and submitted that his presence may be marked. - Sd/-
