This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.33/2025 registered at Police Station Singhoda, District- Mahasamund (C.G.) for the offence punishable under Section 20(b) of Narcotic Drugs and Psychotropic Substances Act, 1986. Case of the prosecution, in brief, is that on 06.04.2025, at around 10:50 A.M., a secret information was received from the informant by the patrolling police that a grey-colored Creta car bearing registration No. MH 16 BY 1011, in which two persons were carrying ganja, was travelling from Odisha towards Chhattisgarh. On the basis of said information, the police stopped the said vehicle and made a search, in which 60 kgs. of ganja was found, which was kept in three sacks of 20 kgs each, amounting to Rs. 9,00,000/-, which was seized from the vehicle in which present applicant-Suyash Bhaurao Gore and co- accused Saurav Sahebram Indapure were travelling and found carrying the contraband article. Thus, the offence was registered, and they were arrested and thereafter the investigation commenced. 3. Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in this case. He would further submit that the mandatory provisions with regard to search and seizure were not complied with in this case. He would submit that the applicant has no criminal antecedents, the charge sheet has been filed in this case, the applicant is in jail since 06/04/2025 and conclusion of trial will take some time, therefore, he prays for grant of bail to the applicant. 4. Learned counsel appearing for the State/respondent would oppose the bail application and submit that the charge-sheet has been filed in the present case before the competent Court.
It is further submitted that a huge quantity of contraband article i.e. 60 kgs. of ganja, was recovered from the alleged vehicle in which the applicant and co-accused were travelling and found carrying the contraband article. This quantity far exceeds the commercial quantity prescribed under the NDPS Act. He
3 also submits that the applicant has failed to provide any satisfactory explanation regarding the alleged contraband article i.e. 60 kgs. of ganja seized from the alleged vehicle. He also submits that bail application of the co-accused person namely Saurav Sahebrao Indapure has been rejected by this Court vide MCRC No. 7221 of 2025 on 25.09.2025. In view of the seriousness of the offence and the quantity involved, it is submitted that the applicant is not entitled to be released on bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, the nature and gravity of the offence, as well as the quantity of ganja, i.e. 60 kgs. seized from the alleged vehicle in which the applicant and the co- accused were travelling and found carrying the same, which is above the commercial quantity as per the Schedule given under the NDPS Act, further noting that the applicant has failed to provide any satisfactory explanation regarding the alleged contraband article seized from the alleged vehicle, the allegation of false implication cannot be accepted, further the fact that bail application of the co-accused person namely Saurav Sahebrao Indapure has been rejected by this Court vide MCRC No. 7221 of 2025 on 25.09.2025, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of the applicant Suyash Bhaurao Gore, involved in Crime No.33/2025 registered at Police Station Singhoda, District- Mahasamund (C.G.) for the offence punishable
4 under Section 20(b) of Narcotic Drugs and Psychotropic Substances Act, 1986, is rejected. 8.
