JUSTICE S G PANDIT AND THE HON'BLE MRS JUSTICE GEETHA K.B. ORAL ORDER (PER: THE HON'BLE MR. JUSTICE S G PANDIT) Heard Sri. N.G. Rasalkar, learned counsel for the complainants and Sri. Sharad V.Magadum, learned Additional Government Advocate for the accused. 2. This contempt petition is filed complaining disobedience of the order dated 21.01.2025, passed in W.P. No.102076/2024, wherein this Court passed the following order: “5. In the light of the said submission, without going into the merit of the claim of the petitioner I deem it appropriate to dispose the petition directing the State to consider the claim of the petitioner in terms of Annexure- W and pass necessary orders strictly in consonance with law within four months from the date of receipt of a copy of the order, if not earlier.” 3. On issuance of notice, accused No.2 has appeared and filed affidavit dated 27.11.2025, enclosing four documents to - 4 - HC-KAR NC: 2025:KHC-D:17761-DB CCC No. 100229 of 2025 indicate the payment of Rs.24,79,147/- towards claim of the complainant. 4. This Court, by order dated 21.01.2025 passed in W.P. No.102076/2024, directed the accused-State to consider the claim of the petitioner/complainant in terms of Annexure-W and pass necessary orders strictly in accordance with law. Accordingly, the accused have passed order in terms of Document No.2, dated 15.11.2025, and have produced a receipt at Document No.4 for having made payment to the complainant. 5. Learned counsel for the complainant, on the other hand, would submit that the claim of the complainant in relation to the work carried out by him, was for more than One Crore Rupees and his claim has not been considered. 6. The direction of this Court is only to consider the complainant’s claim which has been considered by the accused. We are of the view that there is substantial compliance of the order of this Court. If the complainant has any grievance that his claim has not been fully considered, it is open for the - 5 - HC-KAR NC: 2025:KHC-D:17761-DB CCC No. 100229 of 2025 complainant to proceed against the accused persons by initiating appropriate proceedings before appropriate forum. 7. With the above observation, further contempt proceedings are dropped. Pending interlocutory applications, if any, stand disposed of as not surviving for consideration.
