GP FOR HOME The Court made the following: THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 15748 of 2024 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…pleased to issue a writ, order or direction more particularly one in the nature of Mandamus declaring the action of the 3th respondent in interfering with the civil disputes between petitioner and 4 th and 5 th respondents in respect of land to an extent of Ac.0.20 cents in Sy. No. 176-5 cents in D. Yerravaram Village, Nathavaram Mandal, Anakapalli District is illegal, arbitrary and violative of Article 14 and 21 of Constitution of India and pass.…” 2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home appeared for the respondents. 3. Learned counsel for the petitioner would submit that the police are interfering with the civil disputes between the petitioner and the unofficial respondents. Learned counsel would submit that a direction may be given to the police. 4. Learned Assistant Government Pleader for Home, on written instructions would submit that based on the complaint given by respondent No.4, a case in cr.No.35 of 2024 for the offences punishable under Sections 447, 427, 323, 506 r/w 34 of IPC was registered against the petitioner and others. Later, a counter-case has been registered against the unofficial respondents. Another case also registered against the petitioner and others vide Cr.No.192 of 2024 for the offences punishable under Sections 447, 341, 427, 509 r/w 34 of IPC. 5. Learned counsel for the petitioners would submit recording the same, the petition may be disposed of. 6. Recording the above said submission, the Writ Petition is disposed of. However, the police are directed to follow due process of law relating to the crimes which have been registered against the parties. There shall be no order as to costs.
