In the wake of registration of several crimes against the petitioner the Competent Authority issued a show cause notice under Section 56 of the Maharashtra Police Act, 1951 (for short “the Act, 1951”), calling upon the petitioner to explain as to why externment order should not be passed. To which an explanation was offered by the petitioner. After considering the material on record, the authority proceeded to pass an order of externment against the petitioner. 2. Aggrieved by the externment order, the petitioner preferred an appeal under Section 60 of the Act, 1951. The Appellate Authority upon hearing, dismissed the appeal and confirmed the order of externment. It is in this backdrop that the petitioner approached this Court and filed present petition. 2 926 CA 3988-2025.odt 3. In the interregnum, the petitioner has presented an application under Section 63 of the Act, 1951, seeking temporary permission to re– enter the area from which the petitioner has been externed, under exception circumstances or specific conditions. 4. Learned Counsel for the petitioner submits that a medical emergency has cropped up. Therefore seeks temporary permission to re– enter so as to attend the aforesaid emergency. 5. In view of the same and considering the fact that the petitioner has already presented an application before Competent Authority, seeking permission under Section 63 of the Act, 1951. Accordingly, the Competent Authority shall take appropriate decision in accordance with law by 18.10.2025, having regard to the medical urgency. 7. Parties shall act upon an authenticated copy of this order. 8. In light of the aforesaid directions, the Criminal Application stands disposed of. 9. List the Criminal Writ Petition on 07.11.2025.
