05.02.2025 tkm/ct 28 C.R.M. (A) 210 of 2025 sl no.53 In Re : An application under section 482 of the BNSS 2023 in connection with Nalhati PS case no. 702/2024 dated 15.12.2024 under section 103(1) of BNS 2023 And In Re : Ejabur Sekh @ Ejabur Sk. …….. petitioner Mr. Sujoy Sarkar Ms. Sneha Srivastava Ms. Debolina Goswami …… for the petitioner Mr. Ranabir Roy Chowdhury Mr. A S Chatterjee …… for the State Ms. Babita Pramanik …… for the de facto complainant 1. Petitioner submits victim had committed suicide and he has been falsely implicated in a case of murder. He prays for anticipatory bail. 2. Learned lawyer for the State opposes the prayer. 3. We have considered the materials on record. Petitioner had a relationship with the victim. Subsequently victim withdrew from the relation. On the fateful day petitioner had called the victim and she was poisoned in his presence. Whether the poison was administered by the petitioner or was self ingested would require his custodial interrogation. 4. In view of the gravity of offence and prima facie involvement of the petitioner therein, we are not inclined to grant anticipatory bail to him. 5. Accordingly, application for anticipatory bail is rejected. (Subhendu Samanta, J.) (Joymalya Bagchi, J.)
