This writ petition has been filed with the following prayer: "direct the learned District Judge, District Mathura to decide the pending civil revision 75 of 2025 (Krishna Chandra Goswami and others Versus Yogesh Sharma and others) filed on 26.03.2025 by the petitioners/Third party against the order dated 03.01.2025 passed by learned Additional Civil Judge (J.D.) in Original suit no. 1610 of 2024 (Yogesh Sharma and another Versus Dauji Goswami) under order 1 Rule 10 of C.P.C. within the time stipulated by this Hon'ble Court." It is contended that in a suit instituted by plaintiffs-respondents No.1 and 2, an application under Order 1, Rule 10 C.P.C. was moved, which has been rejected by the trial Court, against which Civil Revision No.75 of 2025 has been preferred, which is pending before District Judge, Mathura. The sole prayer made in the writ petition is for expeditious disposal of the said revision. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, District Judge, Mathura is hereby requested to proceed with Civil Revision No.75 of 2025 and take a final call within three weeks and decide the same, in accordance with law, after hearing all affected parties. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
