Heard Sri Nisheeth Yadav, learned counsel for the petitioner as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner though has prayed for quashment of the order dated 01.04.2025 passed by respondent no. 3, whereby, he has shown his inability to decide the claim of the petitioner on account of report yet not furnished by Senior Superintendent of Police, Gorakhpur for which he had written a letter and sent a number of reminders. Learned Standing Counsel submits that since the petitioner was subjected to disciplinary proceedings while being posted at Gorakhpur, so naturally the report is a must. In the given facts and circumstances, this petition stands disposed of with a direction at the first instance to the Senior Superintendent of Police, Gorakhpur to immediately submit his reply to the letter of Superintendent of Police, Maharajganj dated 02.01.2025 and the reminders made subsequently on 10.01.2025 and the last one being 26.03.2025 within a period of four weeks of presentation of certified copy of this order. Soon after the report is received by the Superintendent of Police, Maharajganj from Senior Superintendent of Police, Gorakhpur, he shall decide the claim of the petitioner within a further period of six weeks by means of a reasoned and speaking order. At this stage learned counsel for the petitioner submits that petitioner is claiming the ACP benefits and he is currently posted at Maharajganj, therefore, Suprintendent of Police, Maharajganj is the competent authority. In my considered view, the Superintendent of Police, Maharajganj should proceed to decide the claim of the petitioner regarding ACP benefits also soon after he decides the claim of the petitioner for salary for the period in question.
