The present appeal has been filed against the impugned judgment of conviction and order of sentence dated 18.09.2025 passed in Special Criminal Case (POCSO Act) No. 39/2024 by Additional Sessions Judge FTSC (POCSO Act) Bastar at Jagdalpur, C.G. whereby the appellant has convicted under Sections 137(2), 87, 2 64(2)(m) and 3(5) of BNS, 2023 and Section 6 of POCSO Act, 2012 by the trial court and it has been brought to the notice that the appellant has already filed an appeal bearing CRA No. 2208 of 2025 through legal aid which is pending before this Court. 2. Learned counsel for the appellant would submit that since the appellant has already preferred appeal bearing CRA No. 2208 of 2025 through legal aid which has been filed prior to the present appeal, therefore he may be permitted to withdraw the present appeal. 3. In view of the above submission, the present appeal, which is second in nature, is not maintainable. However, appellant is to pursue the appeal through legal aid filed as CRA No. 2208 of 2025. 4. The present appeal being redundant is dismissed as withdrawn. 5. Mr. Ishan Verma, learned counsel appearing for the appellant may file his Vakalatnama or appear on behalf of the appellant in CRA No. 2208 of 2025. 6.
