1. An Application has been filed jointly by the Appellant through the Authorized Representative Amit Saini and the Respondent Sant Ram Karta of HUF who is also having a Power of Attorney of Manju Rustagi. Also, the Application is supported with the Affidavit of Manju Rustagi. The Special Power of Attorney executed by Smt. Manju Rustagi in favour of Sant Ram filed in the Court today, be taken on record. 2. The Authorized Representative and Sh. Sant Ram for himself and as Power of Attorney Holder of Smt. Manju Rustagi are present in the Court, who have endorsed the terms of the Settlement. 3. It is stated that a Compromise has been arrived at voluntarily without any fear and coercion. The parties undertake to remain bound by the terms This is a digitally signed order. of the Settlement. 4. As per the Settlement, the possession of the First Floor, Second and Third Floor and Mezzanine Floor of the Suit premises i.e. C-2/7, Community Centre, Phase-II, Ashok Vihar, Delhi, shall be handed over to the Respondent by 31.12.2026 for which rent of Rs.45,000/- per month for the First, Second and Third Floor of the Suit property. It is further agreed that User and Occupation charges @ Rs.979/- per month shall be paid for the Mezzanine Floor of the property in question. It is further submitted that Rs.8,30,289/- have been paid and received by the Respondent towards arrears of User Charges for the aforesaid premises. Additionally, the Appellant has paid Rs.11,25,000/- for mitigation of the disruption.
It is further agreed that the Appellant shall not claim any amount on account of properties, tax and would forgo the same subject to the obligations under Agreement being performed by the second party. It is further agreed that the second party/ Appellant shall pay Electricity Bill, Telephone Bills of the premises till the date of vacation of the premises. 5. The parties are directed to remain bound by their terms of the Settlement. 6. The Application is allowed and stands disposed of accordingly. RFA 1199/2025
7. In view of the above, the Appeal stands disposed of along with the pending Applications. 8. The next date of 15.09.2026 fixed in the matter, stands cancelled.
