The instant writ petition has been filed with the following relief:- " to issue a writ, order or direction in the nature of mandamus or directing the respondents to forthwith consider the requisition of vacancies and permit the petitioners-institution to fill up the vacancies on the post of Assistant Accountant (1 post), Lab Assistant Botany (2 post), Lab Assistant Chemistry (1 post), Lab Assistant Zoology (2 post) and Lab Assistant Psychology (1 post) total 07 posts in the petitioners-institution." 2. Learned counsel appearing on behalf of the petitioners without entering into the merit of the case, made an innocuous prayer for a direction to the Director Higher Education (Respondent no. 2) to decide the application dated 11.9.2023 pending before him since 2023 expeditiously. 3. Per contra, learned Standing Counsel appearing on behalf of the State submitted that the petitioner admittedly has moved application dated 11.9.2023 before the District Inspector of Schools, Gorakhpur which is pending before him as submitted by the petitioner. However, he has no objection if the respondent no. 2 is directed to decide the aforesaid application of the petitioner. 4. Heard learned counsel for the petitioners and learned Standing Counsel for the State. 5. Without entering into the merit of the case, I am inclined to allow the innocuous prayer of the petitioner for a direction to the Director Higher Education (Respondent no. 2) to decide the application dated 11.9.2023 pending before him since 2023, expeditiously. 6. In view of above, the writ petition is disposed of with a direction to respondent no. 2 to decide the application of the petitioner dated 11.9.2023 expeditiously in accordance with law, preferably, within a period of six weeks from the date of production of certified copy of this order.
