Through this writ petition, challenge is thrown to the award dated 06.03.2023 (Annexure P-5), whereby, the respondent No.2- Permanent Lok Adalat has directed the petitioner to release the requisite electricity connection to the respondent No.1 within two months for running his tubewell, subject to the condition that the latter submits an indemnity bond thus undertaking that no harm will be done to the electricity wires for installing the tubewell connections and in case any damage is caused, he would compensate the petitioner- electricity board and further that all the charges shall be paid to the petitioner. 2. The learned counsel for the petitioner submits that, in pursuance to the award (supra) as well as the interim order passed by this Court on 03.07.2023, the petitioner has, vide memo dated 10.07.2023, already informed the respondent No.1 to submit application for new tubewell connection along with requisite documents and indemnity bond as per Sale DEVINDER YADAV 2025.02.05 16:22 I attest to the accuracy and authenticity of this order/judgment CWP-13544-2023 2 Circular No.U-24/2021. He further submits that, in case the respondent No.1 makes the apposite application, which is accompanied by all the requisite documents and indemnity bond, the tubewell connection will be released to him. 3. The relevant extract of the memo dated 10.07.2023 is reproduced hereunder:- “In this connection, it is intimated that as per order of Hon’ble Punjab & Haryana High Court Chandigarh on dated 03.07.2023 in court case No. (CWP No.13544/2023). You can be submitted application for new Tube-well connection along with requisite documents and indemnity bond as per sale Circular No. U-24/2021. So you are requested to submit application for your new connections in this office as per Hon’ble Court direction.” 4. In view of the specific stand taken by the learned counsel for the petitioner, no further direction is required to be passed. Therefore, the instant petition is closed. 5. Needless to say, it is open for the respondent No.1 to apply for new tubewell electricity connection to the petitioner by making the apposite application, which shall accompanied by the requisite documents and indemnity bond. In case, any such application is made by the respondent No.1, the petitioner shall release the electricity connection within two months from the date of making of the said application. 6. Disposed of accordingly.
