The present writ petition under Article 226 of the Constitution of India has been preferred with the following prayer :- (i) Issue a writ, order or direction in the nature of mandamus commanding the respondent No. 3 to take appropriate action and demolish the house No. 34/37 of petitioner situated at Etawah Bazar, police Station-Peelkhana, Kanpur Nagar, District-Kanpur. (ii) Issue a writ, order or direction in the nature of mandamus commanding the respondent No. 3 to decide the application dated 11.2.2025 moved by petitioner. A reading of the writ petition and the documents annexed with the same show that the building is occupied by a tenant who has been arrayed as respondent No. 4 in the present writ petition. It appears that the writ petition has been filed only to get the tenant evicted from the property. The petitioner has the remedy to approach the concerned authority under Section 21(2) of the Uttar Pradesh Regulation of Urban Premises Tenancy Act, 2021. The writ petition is dismissed.
