JITENDRA KANYALUR 5 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 12189/2024 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue any order or direction one in the nature of writ of Mandamus declaring the action of the respondent Nos.3 to 6 in interfering with the peaceful possession and enjoyment of our lands Ac.0.26 cents in Sy.No.105/1 and Ac.0.62 cents in Sy.No.104/3G (3G2) of BK Palle Revenue Village, Madanapalle Mandal, Annamayya (Chittoor) District at the behest of the unofficial respondents and threatening us to settle the land in favour of them and execute bonds in their favour, contrary to the Injunction granted by the Civil Court vide its order dt.05-05-2023 and 27.07.2023 in OS No. 337/2023 and O.S.No.550 of 2023 respectively as illegal and arbitrary and consequently direct the respondents not to interfere with the peaceful possession and enjoyment of their lands Ac.0.26 cents in Sy.No.105/1 and Ac.0.62 cents in Sy.No.l04/3G (3G2) of BK Palle Revenue Village, Madanapalle Mandal, Annamayya (Chittoor) District.…” 2. Heard Sri Raja Reddy Koneti, learned counsel for the petitioners, learned Assistant Government Pleader for Home, learned Assistant Government Pleader for Revenue, Sri K.A.Narasimham, learned counsel for the unofficial respondent Nos. 9 & 10 and Sri K.Jithendra, learned counsel for the unofficial respondents. 3. Learned Assistant Government Pleader for Home, by way of counter affidavit, would submit that on the complaint made by the petitioners, a case in Cr.No.85 of 2023 was registered against the 7th respondent and the same is pending for adjudication vide C.C.No.629 of 2023 on the file of II Additional 6 Junior Civil Judge, Madanapalle. Learned Assistant Government Pleader for Home would further submit that the police are not interfering in the civil disputes between the parties. He would further submit that the petitioners submitted a representation in the month of May, 2024, during the General Elections, so the police could not attend to the same. Subsequently, the police called the petitioners to the police station, but the petitioner did not turn up. 4. Learned counsel for the petitioners would submit that the petitioners have filed a civil suit in O.S.No.337 of 2023 and obtained ad-interim injunction vide Orders dated 05.05.2023 in I.A.No.549 of 2023, which was extended till further orders. 5. Learned counsel for the unofficial respondent Nos. 9 & 10, would submit that the Order of injunction is in force. 6. Recording the above said submissions, this Writ Petition is disposed of. However, the police are directed not to interfere in the civil disputes between the parties. The petitioners are at liberty to approach the police as and when required and also can pursue his remedy before the Civil Court where the suit is pending. No order as to costs.
