According to petitioner, respondent no. 4 has made encroachment over public park by constructing a shop. In this writ petition, petitioner has sought the following relief:- (i) Issue a writ, order or direction in the nature of mandamus directing the respondent authorities to remove illegal construction and encroachment over the Runnel (Naala) and public park situated at Indra Enclave, Phase-II, Bhupatwala, District Haridwar. (ii) Issue a writ, order or direction in the nature of mandamus directing respondent authorities, not to permit any illegal construction and encroachment over the public utility land. 5. We are not inclined to grant the relief as prayed for. This appears to be a private interest litigation, which has been given colour of PIL. 6.
