GP FOR HOME 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 35765/2025 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer: “…to issue an appropriate Writ, order or direction, more particularly one in the nature of writ of MANDAMUS declaring the inaction of the official Respondents in executing the NBW against the 4th Respondent in M.C.No.380 of 2017 on the file of the court of Hon’ble Judge, Principal Family court at Vijayawada as arbitrary, illegal, capricious and consequently direct the official Respondents to execute the NBW forthwith.…” 2. Heard Sri Sai Gangadhar Chamarty, learned counsel for the petitioner and Sri.P.Ajay Babu, learned Assistant Government Pleader for Home for the official respondents. 3. Learned counsel for the petitioner would submit that the respondent- police are not executing the Non-Bailable Warrant issued against the 4th respondent in M.C.No.380 of 2017 on the file of the learned Principal Family Court, Vijayawada. 4. Learned Assistant Government Pleader for Home, on written instructions, would submit that in obedience of the Orders of the Superintendent of Police, SPSR Nellore District dated 24.01.2025, the respondent-police have succeeded in getting hold of the warrantee/respondent No.4 in Nellore City on 19.12.2025 and later, he was produced before the learned XII Additional District Judge, Vijayawada, incharge of IV Additional District Judge-cum-Principal Family Court, 4 Vijayawada, on 20.12.2025, where the learned Judge has issued proceedings and ordered the warrantee to be released forthwith as he prayed the Court to release him as he paid an amount of Rs.1,00,000/- and undertakes to pay the balance of amount of Rs.3,20,000/- by 02.01.2026, if he is not required in any other case. 5. Recording the above said submissions, this Writ Petition is disposed of. No order as to costs.
