Neutral Citation No. - 2025:AHC:81571 Court No. - 4 Case :- WRIT - A No. - 6783 of 2025 Petitioner :- Ranjan Kumar Pandey Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Mohammad Mustafa Counsel for Respondent :- C.S.C.,Sudhir Bharti Hon'ble Ajit Kumar,J. 1. Heard learned counsel for the parties. 2. Petitioner is aggrieved by the order passed upon his representation which he had made against the respondent No. 5 an employee of the respondent establishment. 3. It is contended that the respondent authority is not justified in rejecting the representation of the petitioner as baseless. 4. Learned Standing Counsel has raised preliminary objection as to the maintainability of this writ petition on behalf of the complainant against respondent No. 5 as petitioner is not member of the service of the respondent establishment and, therefore, cannot have any stake. 5. Upon a pointed query being made counsel for petitioner could not dispute that petitioner was not employee of the respondent establishment, however he pleaded that his complaint deserved examination by the authority regarding certain developmental activity which was carried out. 6. In my considered view neither the complainant writ petition is maintainable against an employee for the discharge of his official duties inasmuch as no public interest litigation is entertainable in service matters. However, if the petitioner has any personal grievance against respondent no. 5 he may take recourse to other forum, if available in law. 7. Subject to aforesaid liberty petition is dismissed consigned to records. Order Date :- 16.5.2025 Nadeem Digitally signed by :- NADEEM AHMAD High Court of Judicature at Allahabad
