1. The petitioner is before this Court seeking the following prayer: a. Issue a Writ in the nature of mandamus, by directing the respondent no. 4 to consider the representation of the petitioner dated 01.07.2020 vide annexure e and the representation dated 20.02.2025 vide Annexure G1.
b. Issue a writ in the nature of Mandamus directing the respondents to consider the representation of the petitioners vide Annexure E and G1 dated 01.07.2020 and 20.02.2025, respectively and to proceed with the process of appointment to the post of associate professor in physical Chemistry subject as per the notification dated 28.10.2017 vide Annexure A and as per the score card published by the respondent no. 4 vide Annexure D.
c. Issue, such other writ, order or direction as this Hon’ble Court deems fit in the circumstances of the case. - 3 -

learned counsel Sri.B.Sharanabasava, appearing for petitioner, learned HCGP-Smt.Girija Hiremath, appearing for respondent Nos.1 to 3 and learned counsel Sri.Shriharsha A. Neelopant, appearing for respondent No.4.

Facts in brief germane are as follows: On 28.10.2017, the respondent No.4 issued a notification calling for applications from eligible candidates for appointment to the teaching posts in the regional local cadre, i.e., Hyderabad-Karnataka region, in terms of Article 371J of the Constitution of India.
4. The contention of the petitioner is that he emerged successful and that his name is found in the select list. The selection after the name of the petitioner being drawn in the select list did not proceed further at all. The contention of the petitioner is that the petitioner has scored the highest.

In the light of the petitioner scoring the highest marks, learned counsel for the petitioner submits that the petitioner was expecting the process of recruitment to be taken forward and an employment being granted to him. On this hope, nearly eight years have passed, but there is no development with regard to the notification being taken to its logical

conclusion. Therefore, the petitioner is before this Court by filing the subject petition in the year 2025.

Learned counsel Sri.Shriharsha A. Neelopant, appearing for the University, submits that since the recruitment itself was contrary to Section 371J, the State Government, long ago i.e., on 08.03.2019, directed the cancellation of the recruitment process and initiation of a fresh recruitment process. 7. In the light of the said communication, the petitioner cannot claim any right crystallized in his favour to have the recruitment process taken to its logical conclusion merely because he had scored the highest marks. It is trite law, that a candidate's name found in the select list will not get an indefensible right to seek a direction to the hands of the respondent to complete the selection process or render an order of appointment to him. A right that has not crystallized cannot be tested on the anvil of Article 14 of the Constitution of India for

entertainment of a petition under Article 226 of Constitution of India. 9. Therefore, leaving open the remedies available to the petitioner in law, the petition stands disposed. Ordered accordingly
